Our mission is to provide the premier social platform to empower chefs of all skill sets & backgrounds to create, share, and discover food from around the world.

By accessing this website or associated apps, including all pages within this website and all pages within any app produced by Pepper App Inc. (collectively referred to herein below as “Pepper” or “Company”), you are agreeing to be bound by these Terms of Service contained herein on this webpage and on the Privacy Policy and the Community Guidelines and the Refund Policy pages (collectively, the “Services” or the “Terms”) and all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws.

These Terms shall govern your use of Pepper. If you do not agree with any of these terms, you are prohibited from using or accessing Pepper. The materials contained in Pepper are protected by applicable copyright and trademark law.

If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole, and such provisions shall be deleted without affecting the remaining provisions herein.

Who May Use the Services

You must be at least 13 years old to use the platform and, if you are under 18, you have a parent or legal guardian’s consent to these Terms or are eligible to form a binding contract with Pepper. Additionally:

  • You are responsible for anything that occurs when anyone is signed in to your account, as well as the security of the account. Please contact us immediately if you believe your account is compromised.

  • You must be 18 or older to become a paid creator eligible for payouts from the platform.

  • By using the platform, you agree that:

  • You are forming a binding contract with Pepper and are not a person barred from receiving services under the laws of the applicable jurisdiction.

  • You will comply with these Terms and all applicable local, state, national, and international laws, rules, and regulations.

  • If you are using the platform on behalf of an organization or entity, you are authorized to do so and have the authority to bind such entity to these Terms, in which case the words “you” and “your” in these Terms refer to such entity.

  • To be clear, if you are under age 13, you may not, under any circumstances or for any reason, access or use the Services.

  • We may, in our sole discretion, refuse to offer the Services to any person or entity and change its eligibility criteria at any time. Further, the Services are offered only for your use, and not for the use or benefit of any third party.

Use License

Permission is granted to temporarily download one copy of Pepper per device for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

  • modify or copy the materials

  • use the materials for any commercial purpose, or for any public display (commercial or non-commercial)

  • attempt to decompile or reverse engineer any software contained in Pepper

  • remove any copyright or other proprietary notations from the materials; or transfer the materials to another person or "mirror" the materials on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Pepper at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

Disclaimer

The materials within Pepper are provided on an 'as is' basis. Pepper makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Pepper does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to Pepper.

Limitations

By using Pepper, you acknowledge and agree as follows:

  • You agree that your use of the service shall be at your sole risk. To the fullest extent permitted by law, Pepper and its officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with this service and your use thereof, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, privacy, security, or non-infringement. Pepper assumes no liability or responsibility for any (1) errors, mistakes, or inaccuracies in this service, content on this service or results that are obtained from use of this service, (2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of this service, (3) any unauthorized access to or use of Pepper’s servers and/or any and all personal information stored therein, (4) any interruption or cessation of transmission to or from this service, (5) any bugs, viruses, trojan horses, or the like which may be transmitted to or through this service by any third party, and/or (6) or for any loss or damage of any kind incurred as a result of the use of this service. We are not responsible for and are not obligated to control the actions of, or information provided by (including content), our users or other third parties.

  • In no event shall Pepper, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (1) errors, mistakes, or inaccuracies in this service, content on this service or results that are obtained from use of the service, (2) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of this service, (3) any unauthorized access to or use of Pepper’s servers and/or any and all personal information and/or financial information stored therein, (4) any interruption or cessation of transmission to or from this service, (5) any bugs, viruses, trojan horses, or the like which may be transmitted to or through this service by any third party, and/or (6) or for any loss or damage of any kind incurred as a result of the use this service, whether based on warranty, contract, tort, or any other legal theory, and whether or not we have been advised of the possibility of such damages. Our aggregate liability relating to, arising out of, or in any way in connection with these terms and/or this service will not exceed the greater of one hundred dollars ($100) or the amount you paid to us hereunder in the six months prior to the event giving rise to the liability. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction

  • You hereby agree to indemnify to the fullest extent Pepper from and against any and all liabilities, costs, demands, causes of action, damages and expenses (including reasonable attorney’s fees) arising out of or in any way related to any of the following: (1) your use of this Service or any of its features; (2) User Content created, published, or otherwise made available on Pepper by you; (3) any transaction or interaction between you and any other user of Pepper; and/or (4) your breach of any of the provisions of these Terms.

These terms and conditions are governed by and construed in accordance with the laws of New Jersey and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

Accuracy of Materials

The materials appearing in Pepper could include technical, typographical, dietary, or photographic errors. Pepper does not warrant that any of the materials on Pepper are accurate, complete or current. Pepper may make changes to the materials contained in Pepper at any time without notice. However, Pepper does not make any commitment to update the materials.

Content

Pepper reserves the right to review or remove all content that appears on the platform. Pepper may take punitive action against any account that posts content that is in violation of our Community Guidelines.

All content on Pepper is the sole responsibility of the person or organization that submitted it. Although Pepper reserves the right to review or remove all content that appears on the platform, we do not necessarily review all of it. As a result, we do not take responsibility for any content that others provide through our platform.

For leaked exclusive content, Pepper will take disciplinary action against any users who, intentionally or unintentionally, leak (defined as any, intentional or unintentional, sharing of content to any platform or medium, including within Pepper) any other user's "exclusive content" (defined as any content that a user posts only to their subscribers OR any content sent by another user within a private message). For every individual leak (one piece of content), accounts that leak the content will be fined a fee of $25 per site the content is found on, billed to the last recorded card the leaker has used. If the leaker does not immediately remove all leaked content from all platforms, we reserve the right to fine the leaker an additional flat fee of $100.

Payment

When you provide payment information, you represent and warrant that the information is accurate, that you are authorized to use the payment method provided, and that you will notify us of changes to the payment information. We reserve the right to utilize third party credit card updating services to obtain current expiration dates on credit cards.

Pepper uses the 3rd party payment platform Stripe and by using this Service and agreeing to Pepper’s Terms of Service, you also agree to be bound by Stripe’s Terms of Service. You expressly understand and agree that Pepper shall not be liable for any payments and monetary transactions that occur through your use of the Service. You expressly understand and agree that all payments and monetary transactions are handled by Stripe. You agree that Pepper shall not be liable for any issues regarding financial and monetary transactions between you and any other party, including Stripe. You are responsible for all transactions (one-time, recurring, and refunds) processed through the Service and/or Stripe. Pepper is not liable for loss or damage from errant or invalid transactions processed with your Stripe account. This includes transactions that were not processed due to a network communication error, or any other reason. If you process a transaction, it is your responsibility to verify that the transaction was successfully processed. You must not process stolen credit cards, or unauthorized credit cards through Stripe and/or your Pepper account.

Users who initiate chargeback disputes will be permanently suspended and blacklisted from the platform. In addition, creators whose subscribers have initiated many chargeback and whose chargeback rates are unusually high may be subject to investigation, and Pepper reserves the right to suspend creators' accounts in case of an unreasonable chargeback rate of their subscribers.

Rights You Grant Us

You retain your rights to any content you submit or post on the platform. Additionally, by using our Services, you grant us a license to use that content. By submitting or posting content on the platform, you hereby grant to Pepper a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, copy, reproduce, publish, adapt, distribute, modify, publicly display, and create such content in any and all media or distribution methods now known or later developed. This includes Pepper’s ability to use this content for service providers or third parties that support our Services, as well as allowing Pepper to use this content to provide, promote, and improve the Services.

Specifically, this also includes the ability for other users to share their version of your post. If you choose to delete your account after a user has shared their version of one of your posts, their post will still be visible with the recipe details. However, your association to the post will be deleted and none of your personal information will be visible.

Your Account

You may need to create an account to use some of our Services on the platform. It is your sole responsibility to safeguard your account, so we advise you to actively protect your login credentials. Pepper is not liable for any loss or damage associated with your failure to protect your account.

Links

Pepper has not reviewed all of the sites linked to its app and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Pepper of the site. Use of any such linked website is at the user's own risk.

Modifications

Pepper may revise these terms of service for its app at any time without notice. By using Pepper you are agreeing to be bound by the then current version of these terms of service.

General

  • We reserve the right to alter these terms at any time

  • We reserve the right to deny access to the platform to anyone for any reason at any time

  • We reserve the right to force forfeiture of any username for any reason at any time

  • You may end your legal agreement with Pepper by deleting your account and discontinuing your use of the platform

How to Delete Account

  1. From Feed, click on Profile on the bottom navigation

  2. Click the Settings icon on the top right corner

  3. Click "Account Settings"

  4. Click the Delete button at the bottom of the screen

  5. Enter username and confirm Delete
